These Terms of Service govern your use of the XRControl application and the ctrlgamehub community website. By using our services, you agree to these terms.

By downloading, installing, or using the XRControl application ("App") or the ctrlgamehub website ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. We reserve the right to modify these Terms at any time. Continued use of our services after any modification constitutes your acceptance of the modified Terms.
XRControl provides an Android application that allows users to create, customize, and share game controller layouts. The ctrlgamehub community platform enables users to browse, download, share, and discuss game layouts. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.
You may create an account through Google OAuth or internal registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.
You retain ownership of the layouts and content you create and upload ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display your content for the purpose of providing our services. You represent that you own or have the necessary rights to your User Content and that it does not infringe the intellectual property rights of any third party.
You agree not to upload or share any User Content that: is illegal, offensive, defamatory, or discriminatory; infringes the intellectual property rights of others; contains malware, viruses, or harmful code; harasses, threatens, or impersonates others; or violates any applicable law or regulation. We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts of repeat violators.
Layouts available on our platform are user-generated and may not be compatible with all games, controllers, or devices. We do not guarantee that any layout will work with your specific setup. You acknowledge that layout use is at your own risk and that game compatibility may change with software updates.
The App, Website, and their content (excluding User Content) are owned by XRControl and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.
Our services may include third-party software components and links to third-party services. These third parties have their own terms and policies. We are not responsible for the content, accuracy, or opinions expressed by any third party, and you use third-party services at your own risk.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE OUR SERVICES AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XRControl SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF OUR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless XRControl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of our services, your User Content, or your violation of these Terms.
We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately. Sections 4, 7, 9, 10, 11, and 13 shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which XRControl operates, without regard to its conflict of law provisions. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation, and if not resolved within 30 days, shall be subject to binding arbitration or the exclusive jurisdiction of the courts in that jurisdiction.
